1. Acceptance of Terms
By accessing or using CloudSignal's services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services. These Terms apply to all users, including organizations and individuals.
2. Description of Service
CloudSignal provides a real-time messaging platform based on MQTT protocol, including but not limited to: MQTT broker services, REST API bridge, push notifications, analytics dashboard, and related tools and APIs (collectively, the "Service").
3. Account Registration
- You must provide accurate and complete registration information
- You are responsible for maintaining the security of your account credentials
- You must be at least 18 years old or have legal authority to enter into these Terms
- One person or organization may not maintain multiple free accounts
- You are responsible for all activities that occur under your account
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Transmit malware, viruses, or malicious code
- Engage in unauthorized access to systems or data
- Send spam or unsolicited messages
- Interfere with or disrupt the Service or servers
- Attempt to reverse engineer or decompile the Service
- Use the Service to harm minors in any way
- Impersonate any person or entity
- Exceed rate limits or abuse system resources
5. Service Levels and Availability
We strive to maintain high availability but do not guarantee uninterrupted service. Paid plans include Service Level Agreements (SLAs) with specific uptime commitments. Free tier accounts are provided "as is" without uptime guarantees. We reserve the right to perform maintenance that may temporarily affect service availability.
6. Payment and Billing
- Paid services are billed in advance on a monthly or annual basis
- All fees are non-refundable unless otherwise stated
- We may change pricing with 30 days notice
- Overages beyond plan limits will be billed at published rates
- Failed payments may result in service suspension
- You are responsible for applicable taxes
7. Intellectual Property
The Service, including all content, features, and functionality, is owned by CloudSignal and protected by intellectual property laws. You retain ownership of data you transmit through the Service. You grant us a limited license to process your data solely to provide the Service.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You are responsible for ensuring your use of the Service complies with applicable data protection laws. MQTT messages are transient; we do not store message content beyond what is necessary for delivery.
9. Termination
Either party may terminate this agreement at any time:
- You may cancel your account through the dashboard or by contacting support
- We may suspend or terminate accounts that violate these Terms
- Upon termination, your right to use the Service ceases immediately
- We may retain certain data as required by law or for legitimate business purposes
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLOUDSIGNAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless CloudSignal and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
